TERMS & CONDITIONS AND PRIVACY POLICY

Welcome to Whisper Canyon Ranch INC (“WCR,” “we,” “our,” or “us”), located in Selma, Oregon. By accessing this website, submitting inquiries, booking accommodations, attending events, or entering the property, you agree to the following Terms & Conditions and Privacy Policy.

1. Oregon Governing Law

These Terms are governed by the laws of the State of Oregon.
Any disputes arising from use of this website or participation at Whisper Canyon Ranch INC shall be resolved in Josephine County, Oregon.

2. Rural Property & Natural Environment Acknowledgment

Whisper Canyon Ranch INC is a 70-acre rural forested property. Guests acknowledge that natural conditions exist, including but not limited to:

  • Uneven ground, rocks, gravel, roots, and natural terrain

  • Wildlife, insects, snakes, and other animals

  • Limited lighting in certain areas

  • Water features and swimming pool

  • Outdoor fires or bonfires

  • Farm or ranch equipment

  • Weather-related hazards

  • Remote location with potentially delayed emergency response times

Guests voluntarily assume all risks associated with being on a rural property.

3. Assumption of Risk & Voluntary Participation

All activities at Whisper Canyon Ranch INC are voluntary and undertaken at your own risk.

Activities may include but are not limited to:

  • Swimming and pool use

  • Yoga and movement classes

  • Sound baths or wellness sessions

  • Forest walks and outdoor exploration

  • Bonfires and social gatherings

  • Dancing or parties

  • Retreats and ceremonies

  • Alcohol consumption

  • Interaction with animals

Guests expressly assume full responsibility for any injury, illness, accident, emotional response, loss, or damage that may occur.

4. Swimming Pool Use

Pool use is at your own risk.

  • No lifeguard is on duty.

  • Children must be supervised at all times.

  • Guests assume full responsibility for swimming, floating, or being near the pool.

WCR is not liable for drowning, slips, falls, or pool-related injuries.

5. Wellness, Emotional & Transformational Experiences

Whisper Canyon Ranch INC may host wellness gatherings, retreats, community circles, or transformational experiences.

Guests acknowledge:

  • Emotional responses or unexpected reactions may occur.

  • Participation is voluntary.

  • WCR does not provide therapy, counseling, psychological services, or medical treatment.

Guests accept full responsibility for their own emotional, mental, and physical wellbeing before, during, and after participation.

WCR is not liable for emotional distress, psychological reactions, personal decisions, or perceived outcomes resulting from participation.

Guests are encouraged to seek licensed professional support for medical or mental health concerns.

6. Third-Party Facilitators & Vendors

WCR may host activities led by independent organizers, instructors, caterers, musicians, vendors, or retreat leaders.

Guests understand:

  • Third parties operate independently.

  • They are not employees or agents of Whisper Canyon Ranch INC.

  • WCR does not control or supervise third-party services.

WCR is not liable for injury, loss, damages, or outcomes arising from third-party activities or services.

7. Alcohol, Cannabis & Prohibited Substances

No Illicit Substances

The possession, sale, or use of illegal drugs is strictly prohibited on the property.

Violations may result in immediate removal without refund and possible reporting to authorities.

Alcohol & Legal Substances

Guests choosing to consume alcohol or other legal substances do so at their own risk.

WCR is not responsible for:

  • Intoxication

  • Impaired behavior

  • Injuries related to substance use

  • Legal or medical consequences

Guests are solely responsible for their actions.

8. Guest Responsibility & Property Damage

Guests are financially responsible for:

  • Damage to property or furnishings

  • Excessive cleaning

  • Missing items

  • Violation of property policies

WCR reserves the right to charge for damages.

9. Right of Removal

Whisper Canyon Ranch INC reserves the right, at its sole discretion, to remove any guest whose behavior is unsafe, disruptive, unlawful, or violates property guidelines. Removal may occur without refund.

10. Force Majeure

WCR shall not be liable for cancellations or disruptions due to events beyond reasonable control, including but not limited to:

  • Wildfire or smoke conditions

  • Extreme weather

  • Natural disasters

  • Utility failures

  • Government orders

  • Public health emergencies

Rescheduling or credits may be offered at WCR’s discretion.

11. Photography & Media Release

By entering the property or attending events, guests grant Whisper Canyon Ranch INC permission to use photographs, video, or recordings taken on-site for marketing and promotional purposes without compensation.

Guests who prefer not to be photographed must notify WCR in writing prior to arrival.

12. Limitation of Liability

To the fullest extent permitted under Oregon law, Whisper Canyon Ranch INC, its owners, staff, contractors, and affiliates shall not be liable for:

  • Personal injury

  • Emotional distress

  • Illness

  • Theft

  • Property loss

  • Acts of nature

  • Third-party conduct

Guests accept full responsibility for their participation and presence on the property.

13. Intellectual Property

All website content, branding, imagery, and materials are the property of Whisper Canyon Ranch INC and may not be reproduced without written permission.

14. Agreement to Terms

By entering the property, booking accommodations, attending events, or using this website, guests acknowledge that they have read, understood, and voluntarily accepted these Terms & Conditions.
